Terms of Service

1. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using ArkLove you represent and warrant that you meet this age requirement. We reserve the right to verify age at any time and terminate accounts found to be in violation.

2. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify FoxApex immediately of any unauthorized use of your account. ArkLove uses phone-number-based authentication provided by Firebase Authentication (Google LLC). One account per person is permitted.

3. Community Standards & Acceptable Use

ArkLove is a faith-inspired dating community built on respect, authenticity, and genuine connection. By using the Service, you agree you will NOT: post sexually explicit, pornographic, or obscene content; harass, bully, intimidate, stalk, threaten, or abuse any person; impersonate another person or misrepresent your identity; create multiple accounts; solicit personal information or money from users; use the Service for commercial solicitation; post hate speech or discriminatory content; distribute spam or unsolicited messages; share another user's private messages or photos without consent; use automated tools or bots to access the Service; or violate any applicable law.

CHILD SAFETY: We have a zero-tolerance policy for child sexual abuse and exploitation (CSAE). Any content that sexualizes minors will result in immediate account termination, content removal, and mandatory reporting to law enforcement and NCMEC. To report CSAE, use the in-app Report feature or contact [email protected].

Violation of these standards may result in immediate suspension or permanent removal of your account without refund.

4. User Content

You retain ownership of the photos, messages, and other content you submit ("User Content"). By uploading User Content, you grant FoxApex a non-exclusive, worldwide, royalty-free, sublicensable license to store, display, and transmit your content solely for the purpose of operating and improving the Service. We do not claim ownership of your content. You represent that you have all rights necessary to grant this license.

5. Photo Verification

To protect our community, ArkLove requires a one-time selfie verification (holding up 3 fingers) before a profile becomes visible to other users. This photo is reviewed solely by authorized FoxApex personnel for identity authenticity. Once your account is approved, the verification photo is permanently deleted from our servers — it is never displayed publicly, never shared with other users, and never retained beyond its verification purpose. The photo is also deleted if you delete your account before approval.

6. Subscriptions & Purchases

Certain features of ArkLove require a paid subscription (Boost, Plus, or Gold). Subscriptions are processed by Apple (App Store) or Google (Play Store) through RevenueCat. FoxApex does not directly handle your payment information.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. To cancel, manage your subscription through your device's system settings (iOS: Settings → [Your Name] → Subscriptions; Android: Google Play → Subscriptions).

All purchases are final and non-refundable except where required by law. Subscribers in Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, and Wisconsin may cancel within 3 business days for a full refund. EU/EEA/UK/Switzerland residents may cancel within 14 days of subscription start.

Initiating a chargeback without first contacting us at [email protected] may result in immediate account termination. If your account is suspended or terminated for a violation, you lose access to subscription benefits immediately. You must cancel your subscription yourself through Apple or Google to stop future charges.

Promotion or referral Gold memberships are non-transferable, have no monetary value, and cannot be exchanged for cash or compensation.

7. Location Services

The Service uses your device location to suggest compatible nearby users. Location data is processed on-device and stored in our database only as a general geographic coordinate. You may disable location permissions at any time through your device settings, though this will limit certain features of the Service.

8. Push Notifications

ArkLove sends push notifications for new matches, messages, and other activity. You may opt out of notifications at any time through your device settings. Notification delivery is facilitated by Firebase Cloud Messaging (Google LLC).

9. Prohibited Conduct

You agree not to: (a) reverse engineer, scrape, or extract data from the Service; (b) impersonate any person or entity; (c) use the Service for commercial solicitation without authorization; (d) interfere with or disrupt the integrity or performance of the Service; (e) attempt to gain unauthorized access to any part of the Service or its related systems.

10. Termination & Account Removal

FoxApex LLC reserves the right to suspend, restrict, or permanently terminate any account at any time, with or without prior notice, at our sole discretion. This includes accounts that: (a) violate these Terms or our Community Rules; (b) engage in conduct deemed harmful, abusive, or threatening; (c) contain false or fraudulent information; or (d) are detrimental to the platform or community. We may also pursue appropriate legal remedies.

Upon termination by FoxApex for a violation, all subscription benefits are forfeited immediately and no refunds will be issued. You may request account deletion at any time through Settings. If your account is in good standing and has not been reported, we hide your profile right away. You then have 30 days to log in and reactivate. If you do not reactivate within 30 days, your account is placed in our deletion queue for permanent removal of your profile, photos, matches, and messages from our active systems. Reactivation may still be possible until queued deletion is completed. If your account has been reported, is under investigation, or is not in good standing, we may skip the 30-day waiting period, keep records as needed for safety or legal compliance, or terminate immediately as described above. You must cancel any App Store or Google Play subscription yourself to stop future charges. Account deletion by FoxApex for a violation is final.

INDEMNIFICATION: You agree to indemnify and hold harmless FoxApex LLC and its officers, directors, employees, and affiliates from any losses, claims, damages, and expenses (including attorneys' fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law.

DISPUTE RESOLUTION: You agree that any dispute arising from or relating to the Service will be resolved by binding individual arbitration rather than in court, and you waive your right to participate in class actions. Before initiating arbitration, you agree to first contact us at [email protected] to attempt informal resolution. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing [email protected].

11. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. FoxApex does not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. FoxApex is not responsible for the conduct, online or offline, of any user of the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, FoxApex LLC and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with these Terms or your use of or inability to use the Service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Florida.

14. Changes to Terms

FoxApex reserves the right to modify these Terms at any time. When we do, we will update the version number and may require you to re-agree before continuing to use the Service. Continued use after re-agreement constitutes acceptance of the revised Terms.
